DEALING WITH COUNCIL'S DURING THE WORLD CUP (PART 5)

All host cities have specific by-laws pertaining to advertising during the World Cup. Mostly, these by-laws are similar. But what can you expect from the city councils?

Firstly, it is important to note that these by-laws do not prohibit any advertisement, but require the council’s approval for any advertisement displayed in certain exclusion zones. This means that it is an approval process for artwork and not for the structures. Secondly, it is applicable in those exclusion zones only.

Exclusion zones

There are two types of exclusion zones. The first exclusion zone is applicable to all structures on private or public land in a 1 km radius around any stadium and 2 km on any main road leading to a stadium.

The second type is applicable only to structures situated on public land on all the so- called protocol roads between the airports and the CBD, as well as between the airports and the stadiums.

Any display of any advertisement inside these exclusion zones needs specific council approval for the artwork.

Ambush Marketing

The purpose of these by-laws is to prevent ambush marketing. This effectively means that advertisements already on display by an advertiser that is not in competition with any of the main sponsors should be approved by the council. Advertisements by competitors of main sponsors will as a rule not be approved regardless of whether the advertisement is legally displayed immediately prior to the tournament.

How does one apply?

There are no prescribed application forms and the method of application will be a letter containing the application and with the following documents attached to it:

1. Existing approval;
2. Map indicating where the structure is situated;
3. Photo’s of the existing structure;
4. Copy of the artwork that is going to be displayed during the tournament;
5. Contract with the advertiser (the rental charged can be blacked out).
6. Motivation why the application should be approved.

The councils should process these applications quite speedily as there are no other application rules applicable that warrant an inspection or the other usual delaying requirements stipulated by normal by-laws.
